Please make sure you read the information below before booking on any of our courses, as this forms the contract between us.

Bookings

Bookings can only be made with us by customers over 18 years of age. By submitting a booking request, you agree to be bound by these terms.

The description and prices of services are correct at point of sale; however Kōmaru Outdoors reserves the right to change descriptions and prices as required.

We require full payment at the time of booking and will send you written confirmation of your booking details on receipt of payment and a signed booking form.

Payment can be made by cheque or electronically via PayPal.

If you are purchasing a course or activity as a gift, you agree that you will provide the recipient with a copy of these Terms and notify them that by attending, they will be deemed to have agreed to abide by these Terms.

We reserve the right to refuse any booking from an individual or organisation without further explanation.

Consent

While safety is an absolute priority on all of our courses and activities, we require all adult course participants to sign a consent form prior to the start of the course, which acknowledges the risks involved.  In the case of children’s parties, we require a consent form to be signed by a parent or guardian in respect of each child attending.

Kōmaru Outdoors, its employees or agents, will not be responsible for any direct or indirect loss, damage or injury resulting from goods or services sold via this website. Nor can we be held responsible for any losses incurred as a result of a customer failing to disclose medical conditions.

Any injuries or accidents must be reported to the course leader or one of our instructors immediately.

Gift vouchers

Gift vouchers are non-transferable and may only be exchanged for services as described on the voucher.

Accessibility

We actively welcome and support the participation of people with disabilities in our courses and activities, though we recognise that certain courses may present difficulties for those with disabilities. We are committed to ensuring that disabled customers are given every opportunity to participate, so we ask that you tell us about any relevant disability at the time of booking. This enables us to do our best to advise which activities are achievable, and meet each customer’s particular needs. We will be happy to provide information about the disabled facilities available on request.

Cancellation – by you

If a customer cancels with more than two weeks’ notice prior to the start of a course or activity, fees will be refunded minus a 25% administration fee.  If notice is less than two weeks, 100% of the course or activity fee will be forfeited.

Cancellation – by us

Kōmaru Outdoors makes every effort to run courses as scheduled, however occasionally circumstances may make it necessary to cancel (for instance due to severe weather).  If we have to cancel arrangements on or before the date of your course or activity, we will give you as much warning as possible and you will be offered an alternative date.  If this is not acceptable, we will refund your course fees. No additional compensation will be payable.

Age restrictions

To take part in our One Day Introduction to Bushcraft or overnight Wilderness Skills Course, you must be over the age of 16 unless specific arrangements have been made prior to booking.

Children attending our family courses or taster sessions must be over the age of five and accompanied by a responsible adult, who agrees to supervise them for the duration of the course. This should equate to at least one adult per two children.

We are unable to cater for children of a younger age.

Children attending our birthday party activities must be over the age of eight, and be given consent from a parent or guardian to take part. An appropriate number of adults must accompany the party, to be agreed in advance.

Parents, guardians, teachers and those in comparable roles in respect of children must maintain control of those minors at all times, to the satisfaction of our instructors and ensure that they observe all rules and the reasonable instructions of our instructors.

Customer conduct

Kōmaru Outdoors expects its customers to behave in a reasonable and safe way and details these requirements in our course joining instructions, which are supplied to all participants on confirmation of booking.  Failure to comply may result in customers being asked to leave the course, without a refund of course fees.

No alcohol or illegal drugs are permitted, and clients must not be intoxicated at any time during the course.

Data protection and privacy

Kōmaru Outdoors is committed to safeguarding the privacy of your data If you have any requests concerning your personal information or any queries regarding our policy, please contact us by emailing enquiries@komaruoutdoors.co.uk .

We collect personal information from you in order that our services can be offered as effectively as is possible.  Customer information including names, contact details and any special needs, disabilities or dietary requirements is collected by us when you request information or make a booking request with us. We may disclose this information to our service providers for the purpose of providing you with your course or activity. Only information necessary for this purpose will be disclosed to them.

Some information, for example relating to your health, may be regarded as sensitive personal data within the meaning of the Data Protection Act 1998. We need this information to cater for your needs, but it is collected on condition that we have your positive consent. If you do not agree to our use of your information, we cannot accept your booking request.

With the exception of certain uses set out in these terms and conditions, we will not disclose any information we keep about you to any third parties unless required to do so by the police or any regulatory or government authority to provide your information and or information concerning your use of this website.  In the case of accident or emergency, personal information may be given to attending emergency services.

If at any stage you would like to remove, check or amend the information held by us about you please email us at enquiries@komaru.co.uk  or write to us at 4 Swift’s Weint, Parkgate, Cheshire CH64 6SJ, and we will take necessary action within a reasonable time. We will take reasonable steps to confirm your identity before making any disclosure of information held by us.

Transmission of Data

While we have taken all reasonable steps to ensure that the information you provide will be kept secure from unauthorised access, we cannot guarantee that the information will be secure during transmission by you to this website

Use of Cookies

Cookies are small pieces of information that are stored by your browser on your computer’s hard drive. Most web browsers automatically accept cookies, but you can usually change your browser to prevent that.

Cookies are used on this site to keep track of the contents of your order once you have made a booking. We do not use cookies to store personal data and we do not link non-personal information stored in cookies with personal data about specific individuals.

Photographs

Photographs taken on our courses may be used on the Kōmaru Outdoors website or in promotional material. Customers who do not wish their photographs to be used in this way must inform one of our instructors at the start of the course or activity.

 

Complaints procedure

If you are unhappy with any element of your arrangements, you should notify us immediately.  If you continue to be dissatisfied at the end of your course or activity, you should email us at enquiries@komaru.co.uk  or write to us at 4 Swift’s Weint, Parkgate, Cheshire CH64 6SJ, setting out your points within 14 days. As long as the above conditions have been observed, the matter will be investigated and a reply will be sent to you within four weeks of the receipt of the complaint.

Insurance

Kōmaru Outdoors has public liability insurance in place to the value of £5million and a copy of our insurance certificate is available on request.

We cannot be liable for damage to customers’ property, or any accidents or losses which occur due to customers failing to follow instructions from our course leaders.

Service provision

Courses are provided by Nicholas Lynch, trading as Kōmaru Outdoors.

We make every effort to provide the courses and activities advertised on our website and will deliver these using reasonable care and skill.

Please note that we may appoint independent sub-contractors to run or assist on our courses or use third parties to supply certain services. We will use reasonable care in selecting competent, independent sub-contractors and third party suppliers but Kōmaru Outdoors is not responsible for the actions or omissions of such sub-contractors or third party suppliers.
